Re Braich (2007), 2007 CarswellBC 2660 (B.C.S.C.) the Supreme Court of British Columbia found that section 215 of the Bankruptcy and Insolvency Act (the "BIA"), which requires a party obtain leave of the Court before bringing an action against a Trustee, applies to actions brought in foreign jurisdictions.
