Pension Jurisdiction Found to Exist Notwithstanding CCAA

In a recent decision the British Columbia Supreme Court held that an order issued by the courts under the Companies' Creditors Arrangements Act (CCAA) did not prevent the superintendent of pensions from performing his statutory duties. On the contrary, the CCAA order specifically contemplated the superintendent's jurisdiction over the pension plan in question.
