HOJ National Leasing Corp., Re, 2008 ONCA 390, Justice Borins of the Ontario Court of Appeal dismissed the appeal of the Registrar, Ontario Motor Vehicle Dealers Act (the "Registrar") appeal to vary a bankruptcy order under rule 37.14(1)(a) of the Rules of Civil Procedure (Ontario) and s. 187(5) of the BIA.
