Builders' liens are more prevalent in economically difficult times, and it is increasingly important for all players in the construction industry to understand how builders' liens work in Alberta. E. Jane Sidnell and Rachel Hird recently co-authored a paper on builders' liens in Alberta that explores the following issues:

  • What is an Improvement?
  • Liening the Interests of Landlords for Lease Improvements
  • Liens for Materials
  • Prevenient Arrangements

The paper examines the prevailing case law, and the rights and remedies available to parties dealing with liens. In addition, the paper provides some tips for drafters of contracts who want their contracts to work well within the context of lien legislation.
