“Cross Canada Review-Québec Cases”, Insolvency Institute of Canada - 19th Annual Conference, Montebello, Québec, September 2008 ( Author and lecturer)
Author(s): Simard, Roger
Date: September 25 2008
This paper by Roger Simard, FMC Partner and the Regional Insolvency | Restructuring Group Lead for Montréal, addresses four topics that could affect Insolvency Law Practices across Canada and was delivered to the Insolvency Institute of Canada.

The first matter is a look back at the restructuring of television network TQS Inc., which caused a few raised eyebrows, since it involved firing an entire news service. It became newsworthy for both politicians and for the media in Quebec. The next two subjects concern the return of the Crown in the insolvency process with two priority issues in the Supreme Court of Canada. The last topic is the cross-border restructuring of ROL Manufacturing, which obtained recognition as a foreign main proceeding under Chapter 15 of the U.S. Bankruptcy Code.

In this Paper:

•      Introduction
•      The unusual restructuring of TQS Inc.
•      Crown claims: again!
•      Cross-Border Issues: the ROL case
