Over the past several years, Canadian courts have embraced the stalking horse bidding process in cross-border insolvency proceedings. Stalking horse bidding is an auction sales process that originated under section 363 of the United States Bankruptcy Code (Title 11 U.S.C.) (the “Bankruptcy Code”) and is used in many Chapter 11 cases.
