The Protection of Complainants From Retaliation Under Human Rights Legislation

In addition to prohibiting discrimination on the basis of certain express grounds, human rights legislation prohibits retaliation or reprisal against those persons who make a complaint or are involved in a proceeding under the legislation. Many employers have carefully written harassment policies that ensure a process in which complainants can bring forward complaints of discriminatory conduct and other inappropriate behaviour in the workplace including personal harassment. Those policies often include measures to ensure that the complainant is not subject to retaliation and that there is an appropriate investigation and response to the complaint.
