Distinctive Features of a Shopping Centre Lease

When Harvey Haber, Q.C. produced Shopping Centre Leases (volume 1), 30 years ago, Herbert Wolfson, Q.C. wrote the introductory chapter with this title. He described the evolution of retail selling and shopping centre development over the previous 25 years. He said:
Many aspects of life in Canada have changed dramatically in the last 20 or 25 years and concepts of retail selling are no exception. The shopping centre has become an increasingly popular method by which retailers bring their goods to consumers. As shopping centres have gained acceptance they have increased in size and complexity and so has the documentation that goes along with them. The purpose of this article is to outline some of the important ways in which shopping centre leases differ from leases of other commercial space.
