The January 2008 U.S. Supreme Court decision in Pakootas v. Teck Cominco shows that Canadian companies can face U.S. regulatory liability with respect to pollution migrating into the United States – liability that frequently is not being accounted for when Canadian permits are negotiated and a design approach is agreed upon.
