Author(s): Cuervo-Lorens, RalphHombach, Sven
Date:  March 1 2008
The January 2008 U.S. Supreme Court decision in Pakootas v. Teck Cominco shows that Canadian companies can face U.S. regulatory liability with respect to pollution migrating into the United States – liability that frequently is not being accounted for when Canadian permits are negotiated and a design approach is agreed upon. In this cover story to the March 2008 issue of Environmental Science & Engineering, Sven Hombach and Ralph Cuervo-Lorens discuss the implications of the Supreme Court’s opinion and what it means for Canadian industry.
