Significant developments in Canadian competition law in 2005 and early 2006 included the Commissioner's first loss in an abuse of dominance case, the first Tribunal decision under the "ordinary selling price" provisions of the Competition Act (the "Act"), a proliferation of new Bureau information bulletins, the largest settlement of a competition class action in Canada to date and U.S. cases with potential implications for Canadian litigants and Immunity Program applicants.
