Canadian Competition Law: The Year in Review

In 2004 and 2005, competition law in Canada continued to evolve through legislative change, enforcement, and litigation. It was also shaped by litigation in other jurisdictions and continued cooperation with competition authorities throughout the world. After years of study and stakeholder consultations on proposed changes to Canada’s Competition Act (the “Act”), the Government introduced legislation that would dramatically increase penalties imposed for civil (non-criminal) anticompetitive conduct to levels equivalent to the maximum fines available for criminal conduct such as conspiracy.
