The Handbook of Competition Enforcement Agencies 2009
Author(s): Zalmanowitz, Barry
Date: April 16 2009
Susan Paul and Barry Zalmanowitz, Q.C., contributed to The Handbook of Competition Enforcement Agencies 2009, a Global Competition Review special report published in association with Fraser Milner Casgrain LLP.

In this special report, Susan and Barry state that Canada’s immunity programme, established by the Competition Bureau in September 2000, was amended in October 2007. According to the bureau, it is its most important means of detecting criminal activity and its contribution to effective enforcement is unmatched. Under the programme, immunity from prosecution is available to the first party to disclose evidence of criminal activity of which the bureau was either not aware or may not be in a position to effectively prosecute without cooperation from a participant in the illegal conduct. Procedures and considerations employed by the bureau under the programme closely resemble those of the US amnesty programme.
