United Mexican States v Karpa is the latest Canadian decision to clarify the extent to which international arbitral tribunals will be accorded deference by Canadian courts. The 2004 decision was a welcome development for the arbitration bar, as there had been a growing concern in the area as to whether previous court decisions which accorded limited or no deference to international arbitral decisions would lead to parties selecting places other than Canada for their international commercial arbitrations.
