Jurisdiction Issues in the Employment Law Context

The expansion of global commerce, increased cross-border business and an increasingly mobile workforce, have all contributed to a significant increase in the frequency with which jurisdiction issues arise in the employment law context.

The purpose of this paper is to provide an overview of the way in which jurisdiction may be an important consideration at the time of hiring; when the transfer or a relocation of an employee is contemplated; and at the time of termination of the employment relationship. An awareness of how jurisdiction may impact upon the employment relationship and determine the rights and obligations of the parties is essential to effective human resources management.
