Indirect Purchaser Class Action Refused Leave to Appeal

Chadha v. Bayer Inc., Canada's first indirect purchaser antitrust class action, will not be argued before the country's highest court, as the Supreme Court of Canada refused to grant leave to appeal. The Court of Appeal for Ontario recently refused to permit the class action to proceed, and in doing so reaffirmed (i) the significance of major issues being common to the class rather than the individual, and (ii) the crucial importance of adequate and reliable evidence. However, it did not determine what the future holds for antitrust class action litigation in Canada.
