Update to Provincial Privacy Legislation Roundup

This newsletter updates the current status of the provincial private sector privacy legislation in British Columbia and Alberta.

The federal Personal Information Protection and Electronic Documents Act (“PIPEDA”) will not apply to the collection, use and disclosure of personal information within a particular province by private sector provincially regulated organizations if that province has privacy legislation that is substantially similar to PIPEDA. While the federal Privacy Commissioner is required under PIPEDA to report and advise as to whether any provincial law meets the test of substantial similarity, the authority to grant an exemption for substantially similar provincial privacy legislation lies with the Governor in Council.
