On January 1, 2004, the Personal Information and Protection of Electronic Documents Act (“PIPEDA”) will purport to apply (subject to any constitutional issues that may be raised) to all private sector provincially regulated organizations that collect, use and disclose “personal information” in the course of commercial activities, unless the organization operates in a province with legislation that is substantially similar to PIPEDA.
