Employer Communications During an Union Organizing Drive

On July 8, 2005, the British Columbia Labour Relations Board released its reconsideration decision in RMH Teleservices International Inc. and BCGEU. The decision addressed the complaint of the Union attempting to organize the RMH workplace. The Union complaint related to employer communications and specific acts in the course of a “campaign” regarding union membership and certification of the RMH workplace pursuant to the Labour Relations Code. The RMH reconsideration decision provides a useful opportunity to consider the development of the law in this area; the competing policy objectives underlying the B.C. Labour Relations Code and the way in which the B.C. Labour Relations Board has placed some limitations on the nature of employer communications in this context.
