Consultation With First Nations Regarding Proposed Pipeline Projects

Over the past decade, there have been significant developments in the law regarding Crown obligations to consult aboriginal people in relation to activities authorized on Crown lands that may impact on aboriginal or treaty rights. Recently, there have been additional developments regarding obligations of a resource developer to consult with aboriginal people and accommodate their interests. For the proponents of pipeline projects seeking to gain access to provincial Crown lands, it is important to be aware of any proven or asserted aboriginal claims to the land itself or to the exercise of treaty or aboriginal rights on the land, as those rights may give rise to obligations on either the Crown, the project proponent or both.
