Personal Property Security Act Issues in Real Estate Transactions

In British Columbia, property is governed by two separate regimes: interests in real property are governed by the Land Act and the Land Title Act (the “LTA”), and security interests in personal property are governed by the Personal Property Security Act (the “PPSA”). In certain circumstances, these two regimes overlap. When this occurs, real property can be encumbered under the PPSA.
