The two main issues in this case are: 1) whether reserve lands which were removed from the reserve and granted to Canadian Pacific Ltd. (“CP”) pursuant to the Railway Act revert to the federal Crown once the lands cease to be used for railway purposes; and, 2) if the lands revert to the Crown, whether those lands are revived as reserve lands. The Court of Appeal upheld the trial decision on both points.
