When Cullity J. released his decision in the above noted case in December 2003, the decision attracted immediate attention. It was the subject matter of a number of case comments and broader commentary. The decision was a significant one in that the court endorsed a total return investment and distribution policy. In today’s climate of low interest rates, it is often difficult for charitable trusts to meet their disbursement quotas. The importance of a total return investment and distribution policy is that it allows charitable trusts to meet their disbursement quotas under the Income Tax Act.
