The Role of Intent in Abuse of Dominance Cases in Canada

Canadian competition law puts constraints on dominant firms which do not apply to other market participants. Delineating those constraints is difficult. How does one distinguish vigorous competition, which is good, from anti-competitive conduct, which is bad? This paper considers the role of the dominant firm's purpose or intent in that determination.
