The Ontario Court of Appeal: An Arbitrator May Order Security for Costs Under The “Domestic” Act

In a decision which seems to reaffirm the autonomy of an arbitrator under the Ontario Arbitration Act, S.O. 1991, c. 17 (the “Act”), the Ontario Court of Appeal confirmed not only that an arbitrator has jurisdiction under s. 20 of the Act to order security for costs, but also that judicial review of such an order is not available.
