The Supreme Court of Canada recently handed down decisions in two cases - Haida Nation versus B.C. (Minister of Forests) and Taku River Tingit First Nation versus B.C. (Project Assessment Director) - that have great bearing on the previously murky area of the duty to consult and, where indicated, accommodate aboriginal groups regarding resource development in areas subject to claims for aboriginal rights and title.
