In this article, Naomi Horrox discusses stress in the workplace and asks the question: Does stress result in a disability? Conditions caused by stress including, but not limited to, depression, insomnia and alcoholism, can constitute disabilities. Whether an employee can prove that the stress caused a disability is largely a function of medical evidence. If it is determined that the employee's stress has resulted in a disability, the employer will then have a duty to accommodate the employee up to the point of undue hardship. This article provides employers with some guidance when dealing with these issues.
