Andrea F. Raso Amer LL.B., B.A., Partner

Andrea is a senior employment counsel having spent the first 16 years of her career with a leading management-side labour and employment firm in Toronto before becoming a partner of Fraser Milner Casgrain. Over the years, she has developed significant expertise acting for a broad range of private and public sector employers and has appeared before all levels of Court including the Supreme Court of Canada.

Andrea is an advocate for her clients in defence of wrongful dismissal and related tort claims; disability benefits litigation; human rights complaints; privacy complaints; injunctions; class actions; employment standards complaints; labour board hearings; rights arbitration and workers compensation and health and safety matters.

Andrea provides her clients with proactive strategies for all human resources matters such as employment contracts, executive compensation, restrictive covenants, policy development, and M&A and restructuring. She regularly provides training to all levels of management on a variety of workplace issues, including harassment and minimizing liability in potential wrongful dismissal claims. Andrea has significant expertise in privacy matters, both in the employment setting and also in respect to commercial transactions.

Andrea’s expertise is built on 19 years of delivering practical solutions to complex workplace issues. Andrea works with employers in many industries, including: IT; financial; transport; mining; forestry; manufacturing; and media. This experience, along with her work in the public sector, has given Andrea insight into a variety of human resource needs and problems for which she has developed innovative strategies.

Andrea is an advocate for her clients before various administrative law bodies such as the human rights tribunal, workers compensation boards, boards of arbitration, privacy commission and labour board. She appears before all levels of court in respect of actions, judicial review applications and appellate cases.

Webb v. 3584747 Canada Inc. (aka Kmart, subsequently HBC) (2004), 69 O.R. (3d) 50 (Ont. CA); leave to appeal to the SCC denied, (2004) S.C.C.A. No. 114 (S.C.C.). 2004 CanLII 14453 (ON CA). This case was the first class action in Canada dealing with the provision of common law notice in a downsizing.
