Marlon is a partner in FMC's Corporate/Commercial and Technology groups.

Marlon has extensive experience in the health/technology areas, advising on regulations and drafting, reviewing and negotiating clinical trial and ancillary clinical research agreements, licensing agreements, master/template agreements, confidentiality agreements, consulting agreements, service agreements and material transfer agreements.

Marlon's experience extends into corporate/commercial law, assisting clients with structural management of their business affairs including organization, corporate structure, statutory requirements, shareholder and director issues, liability issues and related matters. He also assists clients with various business transactions including purchase and sale of businesses (assets and shares), financing arrangements, negotiating and preparing contracts and related matters.

Marlon is lead counsel for Canadian clinical trials matters for:

  • a NASDAQ-listed pharmaceutical company,
  • one of Canada’s largest academic health regions,
  • one of Canada’s largest universities,
  • one of Canada’s largest clinical research site management organizations,
  • a leading Canadian clinical research organization, and
  • a syndicate of prominent non-academic research sites located across North America.

As lead counsel, Marlon has recently led legal teams on numerous complex matters, including:

  • the formation of Canada’s only Phase 1 Clinical Investigation Unit located within a major teaching hospital,
  • a multifaceted international clinical trial involving over 50 clinical research sites across North America and Europe,
  • the sale of the clinical trials division of a large Canadian company, and
  • several high-profile M&A arrangements.

He has also done a substantial amount of contract review, drafting, negotiation, and other legal work for an international software company, including a legal secondment with that company.

Marlon is a highly sought-after speaker, receiving numerous requests each year to present and chair sessions in the area of clinical trials at prestigious national and international conferences. He has also presented on the topic of clinical trials risk management issues at the University of Alberta, Faculty of Medicine and Dentistry. Marlon is a certified Clinical Research Contract Professional (CRCP) and a published author of several articles on clinical trials risk management. He has also developed and presented educational sessions for various clinical trials clients. Marlon has also been a guest lecturer on business law at Grant MacEwan University, School of Business.
