Louis Dumont has 28 years of experience in bankruptcy, insolvency, restructuring and commercial litigation including product liability, franchising and real estate.

Louis advises clients in matters of local, national and international bankruptcy and insolvency, restructuring mandates and the sale of distressed businesses. He has represented secured lenders in enforcing their security through the exercise of bank security, hypothecary rights and remedies, defending their security against challenges by others, as well as lender liability issues.

Louis has also represented corporate debtors with respect to the reorganization of debt and equity and has represented several accounting firms in their capacity as trustees in bankruptcy, interim receivers, monitors and court-appointed receivers.

Louis has been involved in numerous court cases involving conflicts of priority and between secured lenders and other creditors. He has also advised several franchisers, manufacturers, suppliers, landlords, guarantors and directors in connection with their obligations, and the protections of their rights in bankruptcy and insolvency related matters.

Louis has published many articles on bankruptcy and insolvency, restructuring and realization of security. He has made a number of presentations and conferences for various associations and organizations such as the Canadian Insolvency Practitioners Association, Insight, The Canadian Institute, the Fiscal and Financial Planning Association, the Canadian Bar Association, the University of British Columbia and the Québec Bar.

Louis has represented numerous manufacturers in product liability cases and class actions. He has been instrumental in defeating several certification requests.

Louis joined Fraser Milner Casgrain LLP (FMC) in 1984 and became a partner in 1988.

Representative Work
Acted for a syndicate of banks with respect to the successful realization of security against the assets of Canadian Steel Foundries and other Canadian subsidiaries of Atchison Casting Corporation, which included movable and immovable assets of a foundry and of pension funds surpluses
Counsel for major secured bondholders with respect to realization of their security in the context of an attempted reorganization of Luminon Light Wave Technology Inc. and Lilt Canada Inc. under the Companies’ Creditors Arrangement Act and in the context of the Bankruptcy and Insolvency Act
Counsel for Tembec Industries in the context of the Companies’ Creditors Arrangement Act proceedings filed by Papier Gaspésia
