Margaret Weltrowska LL.B., Partner

Margaret Weltrowska practises primarily in commercial, corporate and civil litigation, construction law, product liability and class action litigation. She regularly appears before the Québec Superior Court, the Québec Court of Appeal, the Federal Court, and various administrative and arbitral tribunals. She has particular expertise in the presentation of extraordinary proceedings such as injunctions, seizures before judgment, and Anton Piller orders. She also participates regularly in important commercial arbitrations.

Margaret joined Fraser Milner Casgrain LLP in 1998 and became a partner in 2008.

Representative Work
Acted for a trust company (General Trust) in connection with a multi-million dollar claim for damages regarding trustees’ liability in an unsuccessful private offering; claim was dismissed by the Superior Court and the Québec Court of Appeal; the Supreme Court of Canada refused leave to appeal
Acted for a computer service provider in connection with a $100 million arbitration brought before the International Chamber of Commerce regarding an outsourcing agreement
Acted on behalf of a party in connection with an ad hoc commercial arbitration arising from an asset purchase agreement and concerning the interpretation and application of an "earn-out" clause
Acted as counsel on behalf of a party in connection with a multi-million dollar commercial arbitration brought before the CCAC arising from an asset purchase agreement and concerning the interpretation and application of an indemnity clause
