Jean-Pierre Dépelteau has 40 years of experience with unique expertise in the areas of infrastructure and construction. He is well-known for his leadership and responsiveness on legal issues in these areas. He advises a variety of public, semi-public and private sector clients, as well as construction contractors, specialized construction companies, and material and equipment suppliers.

Jean-Pierre is familiar with risk assessments as well as the drafting and negotiation of P3, EPC and EPCM arrangements. He is also familiar with all related engineering, supply, construction, operations and maintenance, and equipment purchase contracts.

In his practice, Jean-Pierre provides legal and strategic advice, and participates in the contract award process in the public and semi-public sectors in Canada, including dealing with compliance, governance, conflicts of interest and unfair advantage issues.

He has been recognized by LEXPERT and The Best Lawyers in Canada as one of Canada’s leading lawyers. Jean-Pierre is regularly invited to lecture at seminars on infrastructure.

Represents Infrastructure Québec and the ministère des Transports du Québec for the conception and the construction of the main structures of the Turcot Project in Montréal

Counsel to Norampac (Cascades Group) in the negotiation and drafting of all contracts related to the grant for equipment and the construction of a new pulp and paper mill in New York valued at $500 million

Acted as legal counsel to Petro Canada in the drafting and negotiation of construction contracts with respect to the coker project and other construction projects at the Montréal refinery (cumulative project value: $900 million)

Acted for Cartier Wind Energy Inc., the largest wind energy producer in Quebec (Baie-des-Sables, Anse-à-Valleau, Carleton, etc.), on the drafting of all contractual arrangements (project value: $1.1 billion)

Acted as legal counsel to the ministère des Transports du Québec on the public-private partnership project for the completion of Autoroute 30; he acted as President of the Due Diligence Committee for Autoroute 30

Acted as legal counsel to the ministère des Transports du Québec as President of the Due Diligence Committee in charge of reviewing the public-private partnership contracts for the completion of Autoroute 25

Acted as legal counsel to the Agence des partenariats public-privé du Québec on the modernization of Montréal’s University Health Centers (CHUM, MUHC and Sainte-Justine UHC) and drafted all contractual arrangements (risk identification, risk spreading, contractual obligations) on a P3 project

Represented Trans-Canada Énergie on different energy projects, including a 507 MW natural gas thermal power plant being constructed in Bécancour, Quebec; provided counsel on all strategic aspects of this project, including management, risk transfer and regulatory permit issues, and actively participated in the risk review and analysis, as well as in the drafting and negotiation of turnkey contracts (project value: $600 million)

Represented The Jacques Cartier and Champlain Bridges Incorporated on the restoration of the Jacques Cartier Bridge in Montréal, revised the construction contracts and provided legal advice with respect to contractor claims (project value: $150 million)

Represented Trans-Canada Énergie in the context of the construction of a natural gas thermal power plant in Cherry Point, B.C. and Portland, Ontario; actively participated in risk review and analysis, as well as in the drafting and negotiation of turnkey contracts

Acted as legal counsel to École Polytechnique de Montréal on an $11 million claim for damages against engineers and a contractor according to the construction of a new building for the school, raising important issues relating to professional liability for faulty design, appraisal errors and mismanagement of work

Acted as legal counsel to Bibliothèque et Archives nationales du Québec during the construction of the Grande Bibliothèque; headed the review of contracts and provided legal recommendations with respect to the awarding of contracts (project value: $100 million)

Represented the Société québécoise d’assainissement des eaux since 1980 with respect to water sanitation program projects of up to $3.6 billion, put in place for numerous municipalities in Quebec; drafted various contracts, provided legal opinions and counselled the organization on contract negotiation, dispute resolution and zoning particulars.
