The 2009 LEXPERT Guide To The Leading U.S./Canada Cross-Border Litigation Lawyers in Canada has been published and includes a new Corporate Tax Litigation update from FMC, along with appearances by leading FMC partners among the featured cross-border litigation news stories.
The Corporate Tax Litigation update, authored by David Spiro, Christopher Steeves, Matthew Peters and Jonah Mayles, provides an “overview of the Canadian tax dispute resolution process, the litigation of transfer pricing disputes and other issues in international tax litigation.”
In Marzena Czarnecka’s “A Litigation Renaissance,” FMC’s Robert Simpson and Lowell Westersund discuss Alberta’s increase in construction litigation since the economic downturn. With many developments cancelled, “it’s raining files” says Robert Simpson, who goes on to discuss litigation arising from other issues such as poor work quality brought on by sub-contracting. Lowell Westersund talks about liability in the construction industry, particularly with respect to the oil sands projects, where “things were going so quickly, some of this stuff was done…in an environment of trust and handshakes.” Lowell notes that many things are “buried” or “missing from contracts,” and will be the focus of future disputes.
