Financing

Financing is a fundamental component in executing commercial real estate transactions and development projects. From multi-residential to condominium and industrial initiatives, Fraser Milner Casgrain LLP (FMC) represents borrowers (real estate owners and managers) and lenders (banks, life insurance companies, government entities and pension funds) in projects of all sizes. Since our professionals have developed deep and ongoing relationships with the key players, we work efficiently by recognizing the extent to which we can negotiate to protect our clients’ interests.

The Financing Group assists clients with establishing and executing financing structures for projects and corporate needs such as mortgage bonds, tenant leases and other secure financing vehicles. Our team also structures assignments, and renegotiates and restructures outstanding loans. Prior to closing deals, we secure our clients’ interests by structuring and implementing the documents governing the relationship between the parties and the security documents. For lenders, we work on the placement of commercial mortgages and related security.

With extensive expertise and knowledge in commercial real estate financing and securitization, our professionals advise on: construction, bond and mortgage financing; financing methods and strategies; matters arising from the mortgage portfolios of pension funds; and enforcement. We also counsel U.S. lenders on the key legal differences that may apply to their Canadian endeavours. To address issues that all our clients may encounter, such as bankruptcy and insolvency matters, we draw on the expertise of FMC’s professionals across our related practice areas.

Actively involved with NAIOP (National Association of Office and Industrial Parks) and CREW (Commercial Real Estate for Women), members of our dynamic team are frequently acknowledged in publications such as Best Lawyers, PLC Which Lawyer? and Lexpert.
