We understand competition law and enforcement and we know the enforcers; we apply that knowledge effectively to achieve successful solutions for our clients. In the increasingly global environment of merger regulation and competition enforcement, we work effectively with clients and lawyers in the U.S., Europe and other continents in coordinating effective responses for our clients.
FMC’s Competition/Antitrust and Foreign Investment Group acts as counsel to private sector clients in competition litigation before the Competition Tribunal and before all levels of provincial and federal courts. We also have in-depth experience advising clients on pricing and distribution strategies, as well as joint ventures and alliances that both meet our clients’ goals and are compliant with competition law.
In addition to the Competition Act, members of our Group are leading authorities in Canada on the foreign investment review requirements of the Investment Canada Act (the “ICA”), including identifying the applicability of the ICA as well as navigating the Ministerial approval process. We have an expert understanding of the foreign investment rules and have written and spoken prolifically about the latest developments in this area. We are also experienced in Canada Transportation Act filings in connection with mergers in the transportation sector.
Our Group’s lawyers are leaders in the competition and foreign investment bars and include a former Chair of the CBA National Competition Law Section, the 2011 Chair of the CBA’s Spring Competition Law Conference, the current Vice-Chair of the CBA Mergers Committee and the former Chair of the CBA’s Foreign Investment Review Committee. We are also active participants in American Bar Association committees.
